1. Acceptance of Terms

By accessing or using DashGuard (“the Service”), operated by JR Capital OÜ (“we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

DashGuard is a database monitoring platform that connects to your PostgreSQL databases using read-only access, runs automated data quality checks, and sends alerts via email, Slack, and WhatsApp when issues are detected.

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

• Provide database credentials with write or administrative privileges.
• Use the Service to store, transmit, or process data in violation of applicable laws.
• Attempt to gain unauthorized access to our systems or other users' data.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse-engineer, decompile, or disassemble any part of the Service.

5. Plans and Billing

DashGuard offers a Free plan and a paid Early Adopter plan. Pricing is listed on our pricing page and may change with reasonable notice. Paid subscriptions are billed monthly. You may cancel at any time; cancellation takes effect at the end of the current billing period.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We access your databases in read-only mode and do not read, copy, or store the actual contents of your tables. Connection credentials are encrypted at rest using Fernet encryption.

7. Intellectual Property

We own all rights, title, and interest in the Service, including its software, design, and documentation. You retain full ownership of your data. These Terms do not grant either party any rights to the other party's intellectual property except as necessary to use the Service.

8. Service Availability

We strive to keep DashGuard available 24/7 but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors outside our control, including third-party service outages, network issues, or force majeure events.

9. Limitation of Liability

To the maximum extent permitted by law, JR Capital OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total cumulative liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless JR Capital OÜ and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

Either party may terminate this agreement at any time. You may delete your account through the Service or by contacting us. We may terminate or suspend your access if you violate these Terms. Upon termination, you may request an export of your data within 30 days.

12. Governing Law

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be resolved in the courts of Tallinn, Estonia, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
